GENERAL CONDITIONS OF SALE
These General Conditions are written in French and are considered the official version which is legally binding.
Payment of a deposit to guarantee the reservation signifies acceptance of our general conditions of sale and the obligations resulting therefrom.
The confirmation email sent to you serves as a contract, with communication of our general conditions of sale.
The parties declare that this lease does not concern premises rented for use as a principal residence or mixed professional and principal residence use.
The premises, the subject of this contract, are rented furnished on a seasonal basis.

The Lessee must behave respectfully towards the rented property and the Lessor throughout their stay. Any complaints or concerns must be addressed directly to the Lessor or their representative in a constructive manner and within established communication channels.
A precise description of the accommodation is attached in the Appendix.
The Lessor rents the accommodation to the Lessee according to the conditions of the reservation made on the Abritel/Homeaway website.
The reservation and rental contract is established for a specific number of people. If the number of occupants exceeds this number, we may refuse the additional persons. This refusal cannot under any circumstances be considered a modification or termination of the contract on our initiative, so in the event of departure of a number of people greater than those refused, no refund will be considered. In addition, the balance of the corresponding stay will be paid to us in full. If we accept the additional persons, you agree to pay the supplement due for them.
The rent includes for the entire duration of the rental, the payment of rental charges and available supplies recalled below within the limits of normal and reasonable use:
- City water
- Town gas – Heating;
- Telephone to landline (excluding special numbers) & mobile
- Fiber optic Internet access via THD WiFi Hotspot “BottleAlaMer” (Password: Cotedopale59)
- Television access via SFR Box 8 (HDMI n°1) 210 channels including cinema, Netflix, Amazon Prime, and IPTV (HDMI 2) via video streaming applications on Box Firestick (description of services in appendix)
The Lessee undertakes not to transmit on the Internet any data that is prohibited, illicit, illegal, contrary to good morals or public order and that infringes or is likely to infringe the rights of third parties, in particular intellectual, literary, artistic or photographic property rights.
The Lessee undertakes to only use appliances intended for normal domestic use on the rental electricity network. It is strictly forbidden to connect appliances that are not designed for typical domestic use, such as equipment that could present:
- an electrical safety risk,
- excessive energy consumption such as additional heaters,
- vehicle battery charging systems
- damage to the electrical installation of the property.
Excessive electricity consumption, which significantly exceeds the usual standard for normal domestic use, could result in additional costs for the Lessee.
The Tenant agrees to use water responsibly and economically during their stay. Reasonable water consumption is defined as daily use corresponding to standard household needs, including cooking, cleaning, personal hygiene, and laundry. Filling a tank such as an inflatable pool or spa is strictly prohibited.
Excessive water consumption, which significantly exceeds the usual standard for normal domestic use, could result in additional costs for the Lessee.
The bank guarantee will be released within 7 days after departure, less, where applicable, the sums covering damage, deterioration of furniture and objects furnishing the accommodation caused by the Tenant, unjustified energy consumption (electricity, gas & water) of the accommodation as well as loss of keys or objects.
The deposit will be fully refunded in the event of cancellation by the tenant 14 days before the rental start date, up to 50% for cancellations between 14 and 7 days before this date. Not refunded if the cancellation occurs less than 7 days before the rental date.
If the Lessee waives the rental, he remains liable for the entire rent.
In cases of booking through third-party platforms, the conditions stipulated at the time of booking apply.
The Lessor waives any recourse that it may be entitled to exercise against the Lessee, in particular by application of articles 1302, 1732 to 1735 of the Civil Code.
Likewise, its insurer will waive all recourse that, as subrogated in the rights of the owner, it could exercise against the tenant (and its insurers) whose liability would be incurred in the occurrence of material damage, costs or losses guaranteed.
As regulated by Article 7 of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, the Lessee expressly consents to the processing of your personal data, for an adequate service.
The Lessee may withdraw your consent at any time. In addition, the Lessee has the right to access, rectify, object, erase (“right to be forgotten”), transfer data and limit the processing of data concerning the Lessee at any time, by mail addressed to the following address: Stéphanie Agez Ducloy 9 avenue du Calvaire 5913 Grand Fort Philippe or by email to stephanie@bouteillealamer.fr.
The signed Contract will be kept by the Lessor for 3 (three) years after the rental period, having evidentiary value for administrative purposes and for taking the contract into account.
The Lessee agrees not to disseminate any comments or images that harm the brand image of the rented property or the owner. This includes, but is not limited to, posting comments, photographs, or any other form of content on social media, online review sites, or other public platforms that could be interpreted as defamatory or malicious.
The Lessee acknowledges that the name of the establishment "Bottle by the Sea" is a registered trademark. Any unauthorized use or infringement of this trademark may result in claims for damages.
The Lessee agrees not to disclose any confidential information regarding the leased property, including, but not limited to, specific location details, security features, or any other item deemed sensitive by the Lessor.
